 Agency Disclosure
Recent Interpretation by the Maryland Real Estate Commission
Regarding Agency Disclosure at the Open House or When Showing Property

The Maryland Real Estate Commission has recently adopted a formal interpretation as to the obligation of a real estate licensee to complete and provide the required agency disclosure form at the time of the open house or when showing property by a buyer's agent where the seller or seller's agent is present at the time of the showing.
Although the Executive Director of the Maryland Real Estate Commission published a synopsis of this matter in the December, 2009/January, 2010 issue of the MAR magazine, the caption of the article did not necessarily catch the attention of REALTORS® who may have perused the MAR magazine. From my experience, very few brokers, managers or licensees are even aware of this new interpretation from the Maryland Real Estate Commission.
