Private Transfer Fee Covenants
Two years ago, Maryland outlawed private transfer fees. Maryland was one of the first states in the nation to take early action to prohibit this practice. Since then, many states have followed suit and state and local Government Affairs Directors encouraged the National Association of REALTORS® (NAR) to work with the Feds to do the same.
As a result, a newly proposed rule would limit Fannie Mae, Freddie Mac and the Federal Home Loan Banks from dealing in mortgages that have private transfer fees covenants attached to the properties. There are exceptions in the regulation for private transfer fees paid to homeowner associations, condominiums, cooperatives and certain tax-exempt organizations that use private transfer fee proceeds to benefit the property. Bottom line, fees that do not directly benefit the property will be barred.
NAR asked state and local associations to send a letter in support of the rule. On February 9, 2011, SMAR President Beth Gilliland sent a letter to Alfred Pollard, General Counsel for the Federal Housing Finance Agency in Washington, DC. Click here to read President Gilliland’s letter.
